Hong Kong’s statutory AMD framework is now in force

The Advance Decision on Life-sustaining Treatment Ordinance (Cap. 651) came into operation on 31 July 2026 . It establishes a legal framework for advance medical directives (AMDs) and do-not-attempt cardiopulmonary resuscitation (DNACPR) orders.

What does an AMD cover?

An AMD records an adult’s advance refusal of specified life-sustaining treatment. It applies if the person later lacks the relevant mental capacity and the stated clinical preconditions are met. It cannot refuse basic or palliative care. Discuss treatment implications with a doctor familiar with your condition.

Witnessing

At least two eligible witnesses are required, including a Hong Kong registered medical practitioner and another adult. Neither may be an interested person. The doctor must explain the directive and its effects and assess capacity. The second witness need not be a solicitor.

Revocation

A maker with the relevant capacity may revoke by statutory methods, including writing, destruction, or verbal or other communication before an adult witness. Review all paper, electronic and certified copies, and notify the healthcare team.

Older documents

Existing AMDs can remain valid if they meet the statutory requirements and state instructions clearly. Arrange a medical review. Earlier DNACPR orders must be replaced using the prescribed statutory forms.

AMD and DNACPR: different documents

An AMD records the patient’s advance decision. A DNACPR order reflects doctors’ clinical assessment and helps rescuers act outside hospital. Ask the healthcare team whether both are appropriate. Keep relevant documents readily accessible.
