Wills FAQ: Everything You Need to Know About Estate Planning in Hong Kong

Answer: A Will is a legal document outlining your wishes for distributing your assets after death. It allows you to name beneficiaries, appoint executors, and even set up trusts.

When should I make a new Will?

Answer: Life changes! Consider updating your Will after major events like marriage, divorce, birth of children, or acquiring significant assets.

What information do I need to make a Will?

Answer: Be prepared with details like preferred executors, beneficiaries (including alternates), potential guardians for minor children (if applicable), and a general inventory of your assets.

How long does it take and what happens after signing?

Answer: While timelines vary, we can create a basic Will within days. Sign with two witnesses (one being a solicitor) , andkeep the original in a safe place.

Can I make copies of my Will?

Is a simple will for HKD1000-3000 enough for me?

It's always fine to make a simple will e.g. executor and beneficiary being the same person or making simple division such as equal division among 2 or 3 beneficiaries. Simplicity will create the least uncertainty. But there are some situations in which you may need more than a simple will and should get expert advice or, at the least, investigate your options. Consult your lawyers !

Is a simple Will enough, or do I need something more complex?

Answer: Simple Wills for basic distribution work well. However, complex situations involving family dynamics, trusts, or special needs children might require expert advice.

How do I change or revoke my existing Will?

Answer: Minor changes require amendments following legal guidelines (consult a lawyer). For major changes, consider creating a new Will revoking the previous one.
